A critical analysis of partition suit practices concerning contemporary legislation and judicial progressions in Bangladesh

Abstract: All parties seek to amicably apportion the joint properties among themselves. The distribution of properties may occur among co-sharers through inheritance or acquisition. If the co-sharers fail, they may seek judicial partition of the contested land in accordance with the prevailing state legislation. Partition lawsuits in Bangladesh serve as a legal remedy for co-owners seeking to divide jointly owned property. This article examines partition suits in Bangladesh, highlighting legal foundations, procedural complexities, and the evolution of judicial decisions. It thoroughly analyzes the court interpretation of partition regulations, the challenges faced by litigants, and the shortcomings that persist in attaining equitable property allocation. Recommendations are suggested to address the challenges and delays impacting the system, aiming to match the partition practice with the principles of equity, efficiency, and transparency.
